TERMS & CONDITIONS

1. The Way Bill
The International Express way bill is non-negotiable and the shipper acknowledges that it has been prepared by the shipper or by International Express on behalf of the shipper. The responsibility of International Express fora shipment accepted under a waybill ceases when the consignee acknowledge the receipt of the shipment by affixing his signature on the return to original copy and/or the delivery sheet. All shipment under the waybill are carried at Owner’s risk.
2. SHIPPERS OBLIGATION AND ACKNOWLEDGEMENT
Shipper / Consignee authorize International Express India to have the Customs clearance (Export as well as Import) done on their behalf and shall be providing all the relative paperwork required at the time of clearance of their parcel/ Parcels at any of port (Whether India or overseas). The shipper warrants that he is the owner of the authorised agent or the owner of the goods transported hereunder and that the shipper here by accepts International Express. Terms and conditions for itself and/or as an agent for and on behalf of any other person having any interest in the shipment. The shipper warrants that each article in the shipment is properly described on this Waybill and it does not contravene the provision of the Indian Post Office Act Or any other law for the time being in force and has not been declared by International Express to be unacceptable for transport as specified under section 12 below and that the shipment is properly marked and address and packed to ensure safe handling. The shipper shall be solely liable for all cost and expenses (which shall without limitations include Octroi sale and local tax costs incurred either in returning the shipment to the shipper or warehousing the shipment pending such return. The shipper accepts the condition that the shipment is being carried by International Express from point of rendering only upto the address shown on this Waybill and in case this shipment has to be rerouting redirected returned for any reason whatsoever the shipper shall pay in advance all charges levied by International Express for such returning / rerouting return as per the normal schedule of International Express as also any octroi. State local taxes imports etc. applicable thereon International Express will hold such.Shipments at Destination mentioned in the Waybill for maximum period of 10 days from the date of shipment Thereafter International Express reserves the right to destroy this shipment without informing the shipper and the shipper indemnifies International Express against of liability. Packing of the material rendered for the shipment is the responsibility of the shipper including placement of such materials inside the containers supplied by International Express if any not withstanding any anything else stated in these terms and conditions.
3. FEES AND PAYMENT
All bookings that you make with ECSS (E Com Shipping Solutions Pvt Ltd) are on prepaid basis and no credit terms. ECSS has the right to hold or return your shipment if payment against same is not cleared. The User is solely responsible for payment of all Duties, Taxes, Legal compliances applicable in destination country until or unless shipment is specifically booked in DDP mode at the time of booking. ECSS is in no way responsible for any of the charges imposed on Consignee in destination country. Unless specified, all charges shall be exclusive of GST and other statutory taxes, as applicable, shall be levied on every Invoice. The payment process would be considered to be complete only on receipt of full fees and all other charges (as payable) into ECSS’s designated bank account. ECSS shall raise invoices for the Services and the freight amount thrice in a calendar month (on 10th, 20th and the end of the month). The invoices shall be mailed to customer as soon as invoice is raised. In case of cancellation of a booking, payment of which was already received by ECSS, the payment shall be refunded within 7 working days after the request for refund is raised by customer.
4. International Express RIGHT OF INSPECTION SHIPMENT
International Express has the right but not the obligation to open an inspect the shipment. International Express reserves the right to refuse shipment not conforming to these terms. and condition without assigning any reason whatsoever.
5. INSURANCE
THE SHIPPER may if be so desires insure his shipments at his own costs.
6. OCTROI
Any Octroi Sales Tax or Duties as may de applicable on this shipment will be payable by the consignee at the time of delivery of the shipment International Express PVT LTD reserves the right of lien on any shipment till all its duties are paid in full in respect of freight octroi taxes and other charges.
7. CHARGEABLE WEIGHTS
Every shipment shall be charged by its CHARGEABLE weight as defined hereunder and not the actual weight the chargeable weight shall be higher or (a) the actual weight rounded of to the next higher half Kg. or One kg as per the rate category agreed to or (b) the volume weight similarly rounded of as in (a)above.
8. LIEN ON GOODS SHIPPED
International Express will have a lien on goods shipped for all freight charges Octroi Customs. States and local taxes advance or other charges of any kind arising out of transportation & warehousing Service hereunder and may refuse to surrender possession of Goods until all such charges are paid. Further such charges are not paid to International Express within 10 days than International Express may store the goods at the defaulting shipper’s consignee’s own risk. International Express reserves its right to sell the goods by public auction. Tender private agreement or otherwise or even destroy the goods without prejudice to International Express other legal remedies to indicated aforesaid are not paid by the shipper/consignee within 10 days except for restricted/Banned items of goods as indicate in Section 12 here in under. International Express does not carry any perishable goods. However in case of perishable goods International Express shall have the right to dispose of or sale the goods immediately and without any the Shipper shall keep International Express indemnified against all claims charges and expenses incurred by International Express due to such perishable goods entering into the networking of International Express.
9. LIMITATIONS OF LIABILITY
Without prejudice to section 9 and section 10 the liability of International Express for any loss and damage to the shipment (which terms shall include all document or presents consign through International Express) shall be lowest of (a) Rs.1000/- (b) the amount of loss damage to the documents or parcel actually substained or(c) the actual value of the document parcel as determined without regerated the commercial utility on special value to the shipper. The actual value of a parcel (which term shall include any item of commercial value which is transported here under) shall be ascertained by reference to the cost by repair or replacement/sale or fair market value not exceeding the original cost of the article actually paid bu the shipper subject to any within the over all limit of Rs. 5000/-
10. CONSEQUENTIAL DAMAGES EXCLUDED
International Express SHALL NOT BE LIABLE IN ANY EVENT FOR ANY OTHER DIRECT OR INDIRECT LOSS HOWSOEVER ARISING whether or not International Express has knowledge that such damages night be incurred including but not limited to loss of income profits interest untility or loss of markets.
11. LIABILITIES NOT ASSUMED
In particular International Express will not be liable for any losses or a damage to the shipment or delay in picking up or delivering shipment if it is. Due to acts of god force majeure occurrence of any cause responsibility beyond the control International Express or loss damage caused through strikes not political and other disturbance such as fire accident of the vehicles carrying the goods explosions beyond out the control of International Express for the goods that are carried by International Express Caused by i) The act fault or commission of the shipper the consignee or any other party claiming an interest in the shipment (including violation of any terms or conditions there of) or any other person. ii) Carriers such as Airlines or Airway not adhering to schedule for any reason whatsoever. iii) Government official discharges of their official duties such as Customs/Taxation Octroi inspection etc. iv) The nature of the shipment of any defecid’s characteristics vice thereof v) Electrical of magnetic injury ensure of other such damages to photographic image or recording in any from. The shipper indeminifies International Express against loss damages penalties, auctions proceeding etc. that may be institued by any Government officials in discharges of their official duties such as Customs/Taxation/Octroi inspection etc. Not with standing what is started above whillst International Express will endeaour to excise its best efforts to provide expenditure delivery in accordance with its regular delivery International Express WILL NOT UNDER ANY CIRCUMSTANCES WILL BE LIABLE FOR RESPONSIBLE FORDELAY IN PICK UP TRANSPORTATION OR DELIVERY of ANY SHIPMENT REGARDLESS OF CAUSE OF SUCHDELAYS. No liability is assumed for any errors and/or omission in any information/date which 30 days of the shipment traveling under the Air Way Bill.
12. CLAIMS
Any claim must be brought by the shipper and delivered in writing of the office International Express nearest to the location at which the shipment is accepted within 15days of the date of such acceptance NO. Claims can be made against International Express beyond this time limit. No claim for loss damage will be entertained until all charged have been paid. The amount of any such claim will not be deducted from any transportation charges ownded to International Express.
13. MATERIALS ACCEPTED FOR CARRIAGE
Except as per written agreement between shippers and International Express. a) Not permitted by law/rules/restrictions in force and b) Any items notified by International Express to be Restricted / Banned Dangerous/Prohibited item including share certificate and blank signes share transfer from. International Express shall not be liable for any such shipment and the Shipper shall keep International Express indemnified against all claims. Charges and Dengerous/prohibited items entering into the network of International Express through the Shipper. A detailed list of materials not accepted for carriage is available on request
